A customs decision appears in the company's online account. While the lawyers read the reasons, finance asks when collection will start and logistics calculates the cost of storing goods that have not been released. The immediate instruction is usually to file an appeal. But an appeal starts a review of the decision; it does not stop everything the decision has set in motion.

Administrative appeal or straight to court?
For most decisions by territorial customs authorities, an administrative appeal is an available remedy, not a mandatory step before court proceedings. A company may appeal to a higher customs authority, go to court or pursue both routes, subject to the rules governing their interaction. Different rules apply to decisions by the Federal Customs Service (FCS) itself and where federal legislation prescribes a special procedure.

Identify the act to challenge
What businesses call a customs value adjustment may involve a series of documents. Customs first decides to amend the declaration, then issues a notice of unpaid amounts and a collection decision. It may later refuse to refund money already paid. Failure to act on the company's application may create another issue. These documents arise from the same review, but impose different obligations and take effect on different dates.
The documents do not necessarily require separate court cases. When reviewing a payment notice or collection decision, the court may also examine the assessment on which it rests. A later act nevertheless has its own legal significance: a separate deadline, a new consequence or a distinct remedy to seek from customs.
Start by identifying the specific act that currently infringes the company's rights, not simply the general dispute. A declaration amendment, collection decision, refund refusal and failure to act cannot be bundled into a request to 'cancel the value adjustment' without examining each one. A higher customs authority may consider related appeals together or separately, but the applicant must identify every challenged act and the result sought.
Decisions, actions and failures to act by the FCS itself are not subject to administrative review under Chapter 51 of Federal Law No. 289-ФЗ. They must be challenged in court. The general procedure also gives way where federal legislation expressly provides a special one.
Calculate the appeal deadline
The administrative appeal period is three months. For a decision or action, it runs from the day the person knew or should have known that a right had been infringed, an obstacle created or an obligation imposed. For a failure to act, it begins when the time allowed for customs to perform the required action expires.

The date printed on the decision is not necessarily the start of the appeal period. Evidence of awareness may include the electronic document record, delivery receipt, postal acknowledgement, online account data, exchange logs and other records. Receipt by an authorised representative, the start of enforcement or other reliable evidence of actual awareness may also count. Forwarding a PDF between company departments does not normally start a new period.
Track the court deadline separately
Track the court deadline at the same time. In a typical business dispute, an application to a Russian commercial court must be filed within three months of learning that a right has been infringed. Time spent on the administrative appeal is excluded, even if the appeal is not examined on its merits. Time used before the appeal was filed remains used: the higher authority's response does not start a fresh three-month period.
The wording on restoring a missed administrative appeal deadline remains uncertain. Article 289(2) expressly refers to actions and failures to act, while later provisions refer more broadly to the three-month period in Article 289(1). The safer course is to appeal a decision within three months. A late appeal should include a reasoned application to restore the deadline and evidence of the obstacles, but restoration must not be treated as assured.
Administrative appeals: time and cost
No state fee is charged for an administrative appeal. It is addressed to the higher customs authority but, as a general rule, submitted through the authority whose decision, action or failure to act is challenged. An appeal against a customs post goes through the relevant customs office. The lower authority must forward the appeal, its opinion and the supporting file within five working days.
An appeal submitted through that route is considered within one month of receipt by the competent authority. If sent directly to the higher authority, the standard period is two months. It may be extended by no more than one further month. A request to the applicant for material documents suspends consideration until they arrive, for a maximum of three months. A procedure with no filing fee can therefore take considerably longer than a month while the challenged act remains in effect.
Court proceedings involve an upfront filing cost. In 2026, the state fee for challenging a non-normative act, decision or action in a Russian commercial court is RUB 10,000 for an individual and RUB 50,000 for an organisation. An application for interim relief carries a RUB 30,000 fee. Joining several independent challenges to different acts in one case may increase the fee: arising from the same customs review does not necessarily make them a single claim.
Prepare both routes in parallel
An administrative appeal and a court application can be prepared in parallel. Filing both is more complicated. If a court is already considering the same act or circumstances that the higher customs authority must establish, administrative consideration will be refused in full or in the relevant part. Compare the subject matter and relief sought before deciding whether the two routes can proceed separately.
How to suspend enforcement
For an ordinary applicant, Article 292 requires a cash deposit or bank guarantee covering at least the payments due under the collection decision. Certain customs service providers and authorised economic operators may, subject to the statutory conditions, use security already provided. A bank guarantee must remain valid until at least seven months after the suspension application is filed.
Submitting the application and providing security do not themselves suspend collection. Customs has seven working days to decide, and the ordinary collection rules continue to apply until suspension is granted. If funds may be debited sooner, compare this route with urgent court relief.
Goods awaiting release require a separate assessment. The obstacle may be missing documents, a requirement to amend information, unverified compliance with prohibitions and restrictions, or another procedural act. An administrative appeal does not replace the steps required for release under the relevant procedure or stop storage and vehicle waiting charges.
A Russian commercial court may suspend the effect of a challenged act or decision on a separate application. Filing the main claim does not secure this relief automatically. The court considers whether refusing relief could make a future judgment difficult to enforce or cause significant harm, as well as proportionality and the balance of interests. A large collection amount, without evidence of its specific consequences, will not usually establish urgency.
Some companies pay the disputed amount to remove the immediate collection risk and continue operating. Payment does not concede that the decision is lawful or remove the right to challenge it. It changes the practical objective: once the decision is set aside, the company must pursue a refund or credit and correct the records showing payment.
What the first appeal should establish
The first appeal defines the dispute and the initial account of the facts. Further documents and refined arguments are allowed, but a substantial change in the account needs an explanation. If the company initially attributed an entire payment to the disputed invoice and later allocated it across several shipments, the revised calculation must explain both the money trail and the original statement.
Records that existed before the administrative appeal are particularly valuable: the complete act and attachments, delivery evidence, original electronic files, earlier submissions to customs, system receipts and version histories. They show what each party knew when the decision was made and when later explanations emerged. Do not hold back an available document for court without an objective reason. Do not assume the court will accept an entirely new evidential record in place of the customs review file.
The appeal must identify the applicant, the customs authority, the challenged decision, action or failure to act, the infringement and the remedy sought. If several documents are challenged, the subject matter and requested remedy for each must remain clear, even within a single submission.
A representative needs specific authority to challenge customs decisions, actions and failures to act. General authority to represent the organisation may not suffice. A legal entity filing electronically uses an enhanced qualified electronic signature. An ordinary email to customs is not a substitute for the prescribed electronic channel.
The higher customs authority may request documents and information needed to assess the arguments. Consideration is suspended while it waits, for no more than three months. If the materials are not provided, the authority may decide the appeal without taking account of arguments that required those materials for support.
Different refusals, different consequences
Refusals to consider an appeal have different consequences. Defects in form, content or proof of authority may be corrected and the appeal resubmitted. The unsuccessful first filing does not restart the three-month period: the corrected appeal must still meet the original deadline, or restoration becomes a separate issue. A missed deadline that is not restored, lack of standing or subject matter, a previous decision on the same issue, or court consideration of the relevant circumstances will generally bar another administrative appeal. Withdrawal also prevents a fresh appeal on the same subject.
A refusal to consider an appeal and a refusal to suspend enforcement under Article 292 must be challenged in court. A decision on the merits of an appeal may be challenged before a further higher customs authority, if one exists, and/or in court. An FCS decision can only be challenged in court.
If the higher authority has not responded after the standard period, any formally granted extension and any suspension period have expired, its failure to act becomes a separate matter to challenge. Depending on the authority's level and the chosen strategy, that challenge may go to a higher authority and/or to court. A failure to act by the FCS itself must be challenged in court.
After a favourable decision
A successful appeal does not automatically reverse every consequence of the original act. Read the operative part: has the act been set aside wholly or partly, and must the lower authority issue a new decision, return funds, correct information or take another step? The directions must be implemented within fifteen working days of receipt unless legislation or the decision itself sets a different period.
Where a collection decision suspended under Article 292 is found unlawful, customs relinquishes its rights under the bank guarantee or returns the cash deposit to the relevant extent. Ending collection, correcting the declaration and customs account, refunding payments and other consequences depend on the decision's terms and the procedure for implementing it.
